Safety, liability and the documents you receive

This page is the long version: who answers for what under Finnish law, which documents you are required to obtain before you sign, what evidence you receive for every person on your site, and what each state in the client view means. The short version — what we offer and how an assignment starts — is on the page for companies.

How we work — in one paragraph

Two ways to work with us: we place our own workers on your site, or we take a defined work package under our own responsibility, with the contract naming who runs the work. In both we are the employer of our people and carry the employer's duties: collective agreement, pay, insurance, occupational health, working-time records and right-to-work checks. Our price structure is open: TES rate, supplements, employer contributions, housing and transport, our fee. On a request from the occupational safety authority (työsuojelu, formerly AVI) we assemble the file for your people and period within one Finnish working day as a rule — with a list of anything it does not yet contain.

In staff leasing the collective agreement is determined in the order of the Employment Contracts Act (55/2001, chapter 2, section 9): the one binding the employer first, then the user company's, where the leasing company has none. Our workers are employed in Finland by a Finnish company; the posted-workers regime (Act 447/2016) is not triggered by our own employment — we confirm this in the written agreement for each assignment.

Our promise — in the words we can keep

Not "you have nothing to worry about". This: for every worker assigned to your site there is verified evidence, a list of known exceptions and a named person responsible for closing them. We reply within one working day.

Where we draw the line

We supply people and teams, and we take defined work packages under our own responsibility; who runs the work on site is set by the contract for the package. We do not take electrical installation contracts in our own name. We do not mobilise people without a confirmed order. We never charge a worker a fee, a deposit or a "service charge", and we never hold passports. We do not place general labourers from outside the EU.

Documents under the Contractor's Liability Act (1233/2006)

Before concluding a contract with us — including a binding order — you are required to obtain seven items: registration in the prepayment, employer and VAT registers; trade-register extract; tax-debt certificate; TyEL insurance and payment of contributions; the collective agreement we apply; occupational health care arrangement; and, in construction, statutory accident insurance. We add liability insurance because clients ask for it.

The obligation applies to staff leasing when the work exceeds 10 working days in total and to subcontracting from 9 000 € excluding VAT. Documents must be no older than 3 months and kept by you for at least two years after the contracted work ends; for a contract longer than 12 months the tax and pension items are refreshed every 12 months. The negligence fee is 2 440–24 420 €, increased 24 420–79 380 € (Decree 504/2024, from 1 September 2024). The most common cause of a fee is receiving the documents after signing, or not keeping them (tyosuojelu.fi, 7 April 2025).

All workers are employed by Gene-Works Oy; the Finnish statutory employer insurance (TyEL and statutory accident insurance) is in force before work starts — we arrange the statutory insurance required by the applicable social-security legislation, and any A1 certificate is checked before work starts — and the certificates are in the package. We do not publish the certificates on the site — you request the package by the button below and it arrives with date and version, so you have proof of when you obtained it. We apply the same rule to our own subcontractors: the same package before signing.

What evidence you receive

The unit is "person + task + site + period". For each one we identify the requirements that apply (law, collective agreement, insurer, site rules — kept separate), the evidence that proves each one, its validity, the open items and the named person at Gene-Works responsible for closing them. Every state carries its basis, source, date and who verified it — a colour nobody signed is worth nothing when an inspector asks.

If the occupational safety authority (työsuojelu — from 1 January 2026 the Finnish Supervisory Agency, Lupa- ja valvontavirasto; formerly AVI) requests information, we assemble the file for your people and the period concerned — contracts and terms, collective agreement and classification, working-time records, payslips, right-to-work basis, contractor's-liability documents, insurance, occupational health and induction records — and we name anything it does not yet contain instead of leaving you to discover it.

What you will not see, by law (Act on the Protection of Privacy in Working Life 759/2004): a worker's tax card, bank account, net pay, garnishments, health data or a library of passport scans. You see the requirements of the job and their verified states, not the worker's private data.

The colour is never alone: every row in the client view carries the word, the check date and how long it is valid. The basis, the source and the name of the person who signed it are kept in the file and handed over with the originals. A colour nobody signed is worth nothing when an inspector asks.

Eight links — from recruitment to documentation

  1. Recruitment

    European recruitment through our own channels: trade, experience, language, right to work. We never charge the worker a fee, a deposit or a "service charge" — the law forbids it (Act 380/2023, section 144).

  2. Screening

    Qualification check against the documents themselves: cards, certificates, welding approvals, previous sites. What we could not verify is written down as not verified.

  3. Compliance

    Finnish compliance before day one: employment contract under the applicable collective agreement, tax number, photo ID with the tax number, safety cards, occupational health care, statutory employer insurance, right-to-work basis under the Aliens Act (301/2004, section 82).

  4. Accommodation

    Housing for up to 400 people near Kajaani and Kuhmo; elsewhere accommodation is arranged per assignment and confirmed in the written offer.

  5. Transport

    Own transport to site, by shift. Housing and transport are separate lines in the price and are never offset against the worker's pay.

  6. Site mobilisation

    Mobilisation with a status per person before day one: what is verified, what is pending and who is responsible. Nobody is mobilised without a confirmed order.

  7. Supervision

    Who runs the work on site depends on the contract for the package: our own foreman or your supervisor. In staff leasing the direction and supervision of the work stay with you — that is what staff leasing is.

  8. Documentation

    Weekly documentation and the inspector's file on request. In a work package the QA folder for the package is ours by the contract; in staff leasing the site documentation remains the user company's and we supply the part that concerns our people.
